As the Doctor Orders…

“A federal district court denies a Medicaid recipient’s request for an injunction to require his home health care agency to provide notice and a hearing before reducing services pursuant to a physician‘s orders. Bernam v. Daines (U.S. Dist. Ct., E.D.N.Y., No. 10-CV-2658, Sept. 2, 2010).”The above paragraph means if you are a patient of a doctor and he tells Medicaid that you no longer need a home health aide, Medicaid will not pay for one.  The fight in this case was that the person whose home health aide was removed sued to have the right to a hearing first.  The complaint was that the doctor could make the decision without a hearing at all.

The court said “no.”  The court explained that the doctor’s word was enough to end Medicaid benefits for a home health aide, and no hearing was needed beyond that.
